Phosphor X ("Phosphor X," "we," "us") is educational market-analysis software operated by Crypto Melodies LLC (Wyoming, USA). It provides technical indicators, generated signals with written explanations, dashboards, an AI assistant, and learning material. Phosphor X is software that informs your own decisions — it is not a broker-dealer, futures commission merchant, exchange, or investment adviser, it does not hold your funds, and it does not trade for you unless you explicitly enable and approve an optional routing feature (see Section 8).
By creating an account or subscribing, you agree to these Terms. If you do not agree, do not use Phosphor X.
You must be at least 18 years old and able to form a binding contract, and your use must comply with the laws that apply to you. By using Phosphor X you represent that you are not located in, a resident or national of, or accessing the Service from a jurisdiction we restrict or that is subject to applicable embargoes or sanctions, and that you are not a person or entity with whom U.S. persons are prohibited from dealing (including any party on a U.S. sanctions or denied-party list). We may use country, IP/ geolocation, and account information to determine eligibility and availability, and we may block, suspend, restrict, or decline service to any person, jurisdiction, or payment that presents a compliance, sanctions, or regulatory concern. You are responsible for everything that happens under your account and for keeping your login credentials secure. Notify us promptly of any unauthorized use. We may suspend or close accounts that appear compromised or that violate these Terms.
Phosphor X is for information and education only. Nothing in the Service is financial, investment, legal, or tax advice, and nothing is a recommendation to buy, sell, or hold any security, futures contract, cryptocurrency, or other asset. Signals, grades, indicators, and AI output describe probabilities and past behavior; they are not predictions and not personalized advice. Every trading decision is yours, and you act at your own discretion and risk.
Trading and investing carry substantial risk of loss, including loss of your entire capital, and with leverage you can lose more than you deposit. We make no guarantee of profit, income, accuracy, uptime, or any specific outcome. Past performance is not indicative of future results. Please read our Risk Disclosure, which is incorporated into these Terms.
Phosphor X computes analysis and signals on a best-effort basis. Market data, third-party feeds, and any order routing depend on providers, exchanges, and market conditions outside our control, and may be delayed, incomplete, or inaccurate. The Service is provided "as is" and "as available," and features may change or be discontinued.
Refunds. We do not offer a general refund policy; refunds, including of any setup fee, are issued on a case-by-case basis at our sole discretion, and nothing in these Terms entitles you to one. To request case-by-case consideration, contact us at the email in Section 16 — before disputing a charge with your card issuer. By subscribing you request immediate access to the Service and, to the extent permitted by law, acknowledge that this waives any statutory cooling-off or withdrawal right; where such a right cannot be waived, these Terms do not limit it.
Cancellation. If you cancel, your subscription remains active until the end of your current billing period, after which access ends — canceling stops the next renewal and you keep full access for the time you have already paid for. Cancellation does not entitle you to a refund of any amount already charged.
Disputes & chargebacks. If you are unhappy with the Service or a charge, please contact us first at the email in Section 16. We review every concern and will work with you toward a resolution — including a refund where we determine one is warranted (see Refunds above). Because a chargeback reverses a payment before we have any chance to make it right, if you initiate a card chargeback or payment dispute without first contacting us, we may suspend your account while we review the dispute and may close it where we determine the dispute was unwarranted or made in bad faith, and we may contest the dispute using our records — including the signed acknowledgment described in Section 15 and our service and access logs. Nothing in this Section limits or waives any chargeback, refund, or other right you have under applicable law or your card network's rules.
Phosphor X may let you connect a third-party brokerage account (for example, through TradeLocker) so the Service can display your account and, on higher tiers, offer tap-to-approve trade routing that you must confirm. Assisted-execution features currently connect to a TradeLocker account. Because TradeLocker does not offer a delegated sign-in (OAuth), connecting requires your TradeLocker credentials: they are transmitted to authenticate, stored encrypted (AES-256-GCM), used only to sign in to your own account to display it and route orders you have authorized, and wiped when you disconnect. You are solely responsible for the orders you approve, for your risk settings, and for confirming that automated or assisted execution is permitted by your broker or proprietary-trading firm. We do not guarantee that any order or protective stop will be placed, filled, or effective, and we are not responsible for broker, exchange, connectivity, or market-data failures. See the Risk Disclosure for details. Before you use these features you will be asked to read and accept the applicable release — the Signal Service Risk Acknowledgment & Release for tap-to-approve routing, and the Auto-Trade Automation Waiver before arming auto-trade — each of which is incorporated into these Terms.
We grant you a limited, non-exclusive, non-transferable license to use Phosphor X for your personal, internal purposes while your subscription is active. You agree not to: resell, redistribute, retransmit, or publicly display the Service, its signals, its analysis, or any licensed market data, except as expressly permitted; scrape, reverse-engineer, or copy the Service; share your account; interfere with or gain unauthorized access to the Service; misrepresent your affiliation with us; or use the Service unlawfully. Some market data is provided under license and carries the data provider's own redistribution restrictions.
We may offer a referral program that pays a commission when a person you personally refer becomes a paying subscriber. Participation is subject to a separate Affiliate Agreement. Affiliates are independent contractors, are responsible for their own taxes, and must not make misleading income or performance claims. Commissions are earned only on bona fide sales and may be withheld or reversed on refund, chargeback, or violation of the Affiliate Agreement.
The Service — including its software, content, signals, and the Phosphor X and Crypto Melodies marks — is owned by Crypto Melodies LLC and protected by law. All rights not expressly granted are reserved.
The Service is provided without warranties of any kind. To the maximum extent permitted by law, Phosphor X and Crypto Melodies LLC will not be liable for any loss of capital, trading losses, or any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service — including losses caused by signals, analysis, AI output, approved or automated orders, missed or delayed protective stops, or third-party, broker, market-data, or connectivity failures. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.
You agree to indemnify Crypto Melodies LLC against claims arising from your use of the Service, your content, your trading, or your violation of these Terms or applicable law.
We may suspend or terminate access for violation of these Terms, for non-payment, or as required by law. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
Before member features open, you must sign an acknowledgment of these Terms, the Privacy Policy, and the Risk Disclosure by typing your full legal name. You agree that this typed name is your electronic signature, that it has the same effect as a handwritten signature, and that you consent to doing business electronically. When you sign, we record your typed legal name together with your IP address, browser identifier, the date and time, and the version of each document you accepted, and we retain those records for as long as we need them to evidence your agreement — including in payment disputes and legal proceedings. If these documents change materially, you will be asked to sign the updated versions before continuing to use member features.
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Wyoming. We may update these Terms on reasonable notice; material changes will be posted here with a new version and effective date, and continued use means you accept them.
